RhythmTrace Terms of Use

RhythmTrace Terms of Use

Effective date: October 11, 2026. Version: 2026-10-11-v1.

These Terms are an agreement between the user and White Hat Mgmt LLC (“White Hat”) for use of RhythmTrace. By using the app, the user agrees to these Terms and the RhythmTrace Privacy Policy. If the user does not agree, the app should not be used.

Health and emergency limitations

RhythmTrace is a self-recording and informational tool. It does not diagnose, treat, prevent, monitor, or cure a disease; provide medical advice; determine fertility or contraception; confirm ovulation or pregnancy; replace a licensed professional; or guarantee an outcome. Patterns, averages, date ranges, confidence labels, and summaries are descriptive calculations from the entries the user confirms and can be incomplete or wrong.

RhythmTrace is not an emergency service. A person who may be in immediate danger must call the emergency number for the current location. In the United States, call 911 for a medical emergency and call or text 988 for a suicide or mental-health crisis. Do not wait for an in-app directory search.

The directory currently queries public United States NPPES records. An NPI record does not confirm current licensure, credentials, quality, availability, insurance acceptance, or that a facility can provide emergency care. Users must verify those facts with the provider and the relevant licensing authority. Maps and route guidance are supplied by the navigation app the user chooses and must be checked before travel.

License and acceptable use

White Hat grants a limited, personal, nonexclusive, nontransferable, revocable license to use RhythmTrace lawfully. A user may not resell, scrape, reverse engineer except where law expressly permits, interfere with security, misuse public-directory access, impersonate a professional, or use the app to harm another person. Open-source licenses and nonwaivable legal rights remain unaffected.

The app works without an account. Local data can be permanently lost if the user deletes it, clears app data, uninstalls, loses the device, or if a device or operating-system failure invalidates protected storage. Users are responsible for the accuracy of entries and for protecting access to their device.

Advertising and in-app purchase

The free version may display one Google-served banner on the Today screen. Ads do not appear in the journal form, history, medical-directory results, emergency guidance, privacy screen, or purchase screen. Ad availability, suitability, and content are controlled by third parties, not White Hat. Users can report an inappropriate ad using the control in RhythmTrace Premium.

“Remove ads” is a non-consumable digital purchase processed by Google Play or the App Store under that store’s price, tax, family, billing, cancellation, and refund rules. It removes Google-served ads from RhythmTrace and unlocks visual themes; all health features remain available without purchasing. Users can restore the entitlement with the same store account. White Hat does not promise uninterrupted availability of a store or its purchase service.

Third-party services

Google Mobile Ads, Google’s consent system, Google Play, the App Store, CMS NPPES, the browser, the operating system, and the selected maps app are independent services governed by their own terms and policies. Denying optional ad consent or declining the purchase does not block the journal. Network-dependent services may be unavailable, delayed, inaccurate, or changed by their providers.

Intellectual property, updates, and termination

The RhythmTrace name, original software, design, text, illustrations, and branding belong to White Hat or its licensors. Public CMS records and linked materials remain subject to their own notices; their inclusion does not imply government endorsement.

White Hat may correct, update, suspend, or discontinue features to maintain safety, accuracy, compliance, or compatibility. White Hat may terminate the license for material misuse. Provisions that by their nature should survive will survive termination.

Disclaimer and limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RHYTHMTRACE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ACCURACY, COMPLETENESS, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, OR A PARTICULAR HEALTH RESULT. This does not exclude warranties that cannot lawfully be excluded.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHITE HAT AND ITS MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST DATA, LOST OPPORTUNITY, HEALTH DECISIONS, OR RELIANCE ON A DIRECTORY RECORD OR ESTIMATE. TOTAL LIABILITY ARISING FROM THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT PAID FOR THE APP DURING THE PREVIOUS 12 MONTHS OR US$25. These limits do not apply where prohibited.

Law, disputes, and contact

New Jersey law and applicable United States federal law govern these Terms, without regard to conflict rules. Courts in Middlesex County, New Jersey have exclusive jurisdiction unless mandatory consumer law provides another forum. Before filing a claim, contact White Hat and allow 30 days for an informal resolution. Nothing waives nonwaivable consumer, privacy, or health rights.

If a provision is unenforceable, it is limited to the minimum necessary and the remaining provisions continue. Failure to enforce is not a waiver. These Terms, the Privacy Policy, mandatory app-store terms, and applicable open-source licenses form the agreement concerning RhythmTrace.
