CDL Navigator End User License Agreement (EULA)

CDL Navigator End User License Agreement (EULA)

Last updated: October 12, 2026

This End User License Agreement (the «EULA») covers CDL Navigator: GPS Truck & Bus (the «App») when you get it from Apple’s App Store. It is a contract between you and White Hat Mgmt L.L.C., a New Jersey limited liability company («White Hat,» «we,» «us»). By downloading, installing or using the App, you agree to this EULA. If you don’t agree, don’t install the App, or delete it.

1. Read this first: you are the driver

YOUR USE OF THIS REAL TIME ROUTE GUIDANCE APPLICATION IS AT YOUR SOLE RISK. LOCATION DATA MAY NOT BE ACCURATE.

CDL Navigator is a navigation aid for trucks, buses, school buses and other commercial vehicles. It plans routes from the vehicle measurements you enter and warns about restrictions it knows about. It is not a safety system. It is not designed, marketed or meant to be used for emergencies or to save lives, and it does not control your vehicle in any way. In an emergency, call 911 or your local emergency number.

  • Road signs, traffic control devices and the law always win over anything the App shows. If a bridge sign says one clearance and the screen says another, follow the sign.
  • If the App doesn’t show a sign, a restriction or a hazard, that doesn’t mean it isn’t there.
  • You are responsible for entering your vehicle’s real height, width, length, weight, axles and any hazardous materials. The App can only work with what you give it.
  • You are responsible for your licenses, permits and authorizations, including oversize and overweight permits.
  • Set your route before you drive. Don’t handle your phone while the vehicle is moving. If what you see on the road doesn’t match the App, stop in a safe place and check.

2. Where the data comes from, and its limits

The App combines data from other sources, including HERE Technologies maps and truck routing, OpenStreetMap data, the FHWA National Bridge Inventory, the National Weather Service, federal fuel price data, U.S. Customs and Border Protection wait times, Department of Transportation work zone data and state mile marker data. None of it is ours and none of it is perfect. It can be out of date, incomplete or wrong. A posted bridge height may no longer match the real clearance after repaving. The App cannot tell whether a weigh station is open, so treat it as open. Tolls and fuel prices are estimates. Speed limits and mile markers are not available everywhere.

The App rounds your vehicle’s measurements up and adds a small margin on purpose. That margin lowers the risk; it doesn’t remove it. Checking real clearance before you pass is still your job.

Route calculation needs an internet connection and depends on third-party services that can fail. Plan for that.

3. Agreement between you and White Hat, not Apple

You and White Hat both acknowledge that this EULA is concluded between you and White Hat only, and not with Apple Inc. («Apple»). White Hat, not Apple, is solely responsible for the App and its content. Nothing in this EULA sets usage rules that conflict with the Apple Media Services Terms and Conditions; if anything here does, Apple’s terms control on that point.

4. Your license

We grant you a limited, non-exclusive, revocable, non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts associated with the purchaser may also access and use the App through Family Sharing, volume purchasing or Legacy Contacts. The App and its content belong to White Hat and its data providers. We license the App to you; we don’t sell it.

You may not decompile or reverse engineer the App or extract its map data for use outside the App (except where the law allows it despite this restriction); use it to plan illegal transport or to avoid weight or inspection controls; or resell access to it or build it into another product without our written permission.

5. Purchases and ads

The App is free. It may offer optional in-app purchases or subscriptions, and it shows ads through Google AdMob. For safety, ads never appear on the map, during a route, or while the vehicle is moving. Apple handles all App Store payments, cancellations and refunds under its own terms. We never see or store your payment details.

6. Maintenance and support

White Hat alone is responsible for any maintenance and support for the App, as described in this EULA or as required by law. You and White Hat both acknowledge that Apple has no obligation at all to provide maintenance or support for the App. For help, write to us at the contact details in Section 15.

7. Warranty

To the fullest extent the law allows, the App is provided «AS IS» and «AS AVAILABLE,» without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that any route is passable for your vehicle or that the App will be free of errors or interruptions.

White Hat alone is responsible for any product warranty, express or implied by law, to the extent it isn’t effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (if you paid one). To the maximum extent permitted by law, Apple has no other warranty obligation at all with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are White Hat’s sole responsibility, subject to the limits in Section 9.

8. Product claims

You and White Hat both acknowledge that White Hat, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims under consumer protection, privacy or similar laws.

9. Limitation of liability

To the fullest extent the law allows, White Hat and its members, employees and contractors will not be liable for indirect, incidental, special, punitive or consequential damages, or for damage to your vehicle or cargo, fines, delays, or loss of profits or data, arising from your use of, or inability to use, the App.

White Hat’s total liability for all claims related to the App is limited to the greater of (a) the amount you paid for the App in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (USD 100).

Nothing in this EULA limits our liability for fraud, willful misconduct, or death or personal injury caused by our negligence, or limits any other right that applicable law says cannot be waived. This EULA does not limit our liability to you beyond what applicable law permits. Some places don’t allow some of these limits; there, they apply only as far as the law allows.

10. Intellectual property claims

You and White Hat both acknowledge that if any third party claims that the App, or your possession and use of it, infringes that third party’s intellectual property rights, White Hat, not Apple, will be solely responsible for investigating, defending, settling and discharging that claim.

11. Legal compliance

You represent and warrant that (i) you are not located in a country or region that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a «terrorist supporting» country or region; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

12. Third-party terms

You must comply with any third-party terms that apply when you use the App, for example your wireless carrier’s data plan agreement and the terms of the App Store.

13. Apple as third-party beneficiary

You and White Hat both acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA, and that once you accept it, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

14. Other terms

Your conduct. You agree to hold White Hat harmless from claims, damages and reasonable costs (including attorneys’ fees) caused by your breach of this EULA, vehicle data you entered incorrectly, or your unlawful use of the App.

Other documents. The App’s Terms and Conditions and Privacy Policy also apply. If they conflict with this EULA, the provision that protects you more controls, except that Sections 3, 4, 6, 7, 8, 10, 11 and 13 always apply as written, because Apple requires them.

Changes and termination. We may update the App and this EULA. We’ll post changes at this same address with a new date. You can stop using the App at any time by deleting it. If you break this EULA, your license ends.

Governing law. This EULA is governed by the laws of the State of New Jersey, USA, without regard to its conflict of law rules. Disputes go to the competent courts of New Jersey, unless mandatory law where you live says otherwise.

Severability. If any part of this EULA is found invalid, the rest stays in effect.
